*later on neopets shuts down due to Mom's lawsuit".

Problem with that is, neopets/JS can just say they put an age restriction on there, which complies with COPA, and the kid lied about his age instead of following what he was supposed to do. They did all they could, and since the kid bypassed what JS had set in place to comply with COPA, it's the kids fault for lying and seeing that stuff due to the lies, and it's the parents fault for not making sure their kid entered the correct age. Therefore, neopets/JS isn't at fault, since the site is in compliance with COPA.

The age restriction for porn may be 18+, but it was posted on the message boards and on petpages (which were linked to on the boards). The boards are 13+, and since none of the links lead to an actual porn site, the 18+ restriction doesn't apply I would think and neopets isn't a porn site either, so there's no 18+ restriction anywhere on the site. Again, JS can just claim that none of the images/links ever lead to a porn site, they were posted on neopets itself, which has a 13 age or lower restriction, therefore, the 18+ rule doesn't apply to their site or to the images. And then since nothing lead to a porn site, they couldn't just slap on an 18+ restriction, and they can argue that children were never directed to a porn site at all, and the pictures posted never involved humans in anyway (which would be a lot worse). Plus, they can also claim, since none of the mods were on, that they had no way of knowing those pictures had been posted, and they couldn't just immediately restrict the whole site to 18+. 

 

It would be a very hard won lawsuit I think. You're going up against a company which probably has a huge team of lawyers.
