How would you even prove that you were using any of these programs in court? O.o
Easy, if you SS or AB with stupid settings, they ice you...so they presume you are using 3rd party programs.
You agree that if you disseminate, design or assist in the design of a third party program that changes the game play on Neopets, you will pay Neopets, Inc. liquidated damages in the sum of Fifty Thousand Dollars for each such program as liquidated damages. You agree that if you use such a program on the neopets.com website, you will pay Neopets, Inc. liquidated damages in the sum of Five Hundred Dollars for each time you use a program.
Now this is the hard part.
See
here on the enforceability as stated by a law firm.
In contrast, the essence of liquidated damages is a genuine pre-estimate of the damage likely to be caused by a breach.
On Australian "Current Affairs" program, the use of liquidated damages by car park owners against people who breach their contract of service came under scrutiny. While they don't have the story on their site,
here is the essence of it. The Consumer Action Law Centre in Australia claims that these sort of claims against people are unlawful.
The amount of damages claimed by TNT seems so extravagant, unless someone was using programs and making a mint out of it (?) then I don't see how a court could justify applying such penalty.
