Consensual sex where one person is below the age of consent is also classed as rape (because the under-age person can't legally consent to it) so there is a valid distinction to be made.

Statuary rape in is defined under the Sexual Offences Act 2004 as a person under the age of 13 and is very similar in many other Westernised countries. I think a lot of people forget that and assume that an 18 year old in a sexual relationship with a 15 year old is committing rape.

It's also worth mentioning that sexual activities between minors or people close to that is rarely enforced legally and is more the subject of social services and so forth so stop criminalising young people for natural urges.

I totally support capital punishment for rapists in theory. As for the circumstances in which I'd say it should be used: if he/she is a repeat offender, and there is concrete, undisbutable evidence that he/she is guilty. Unfortunately, I think the latter is pretty rare. If we had a perfect or near perfect system I'd support it, but I think our justice system makes a lot of mistakes and lets a lot fall through the cracks, so I wouldn't support it now.

But I do think that rapists deserve the death penalty. Killing rapists or muderers doesn't go against my moral code at all, personally. I think people have the right to live peacefully. Meaning that you have the right to live however you'd like as long as you dont hurt or abuse other people, and that you have the right to live without other people abusing you.

I know that but also the same time they try to distinguish a difference between a woman who is passed out drunk or a woman who just let's the rape take place instead of fighting between violent rapes. Those are not classified as forcible rapes. I guess a woman has to have a black eye for her rape to be considered valid.

    Statuary rape

Statutory. If it's statuary rape, you're molesting a weeping angel. Also I'm fairly certain it's not restricted solely to "under 13" in the US at least, because 13 is not the age of consent in any US state that I've ever heard.

Many times there is a truly appalling argument that if a woman does not fight tooth and nail to prevent the rape from happening, it wasn't rape. This defense is increasingly rare in terms of success, given the general understanding that scared people want to not die.

    No! No way!

They should be castrated and have the would cauterized.
Then they should live the rest of their days in a dark pit where interaction with humans is minimal.

No sun light, no seeing the face of a human being, no books, no TV etc...

Too far. I like the castration idea, but it should be paired with intensive therapy, the intent of which should be healing them and allowing them to reenter society.

Most in this society see punishment only for vengeance, the idea to heal a damn soul has almost been forgotten.

What would classify as intensive therapy?

There's this idea that you can sit a mentally disturbed person down with a therapist or support group, and talk away all their problems. How will talking correct/heal the way their mind functions? Suppose they need medication to correct some chemical imbalance that is causing them to go on sexual power trips, who will ensure that the medicine is being taken? Also, given that the person has already committed a crime once, why on earth would we want to give them the benefit of the doubt that they're not going to do it again?

Do you believe that any soul is so lost that it can not be redeemed? But, that is not the same as rehabilitation, some can never be trusted to interact with innocents again, this is true.

I believe the best sentence for a rapist is to let someone rape them, and for a heavy offense castration would probably the way to go

I have known a few monsters in my life, and sadly to a man they had once been innocent children abused by other monsters. If abuse can turn a person into a monster, is there nothing that can turn a monster back into a human being.

Not all abused become monster, but none ever completely heal.

Aiyee, but I am speaking more of those that abuse children, that grow up to abuse. Not your standard rapist.

I suppose the rules of debate must be set.

yes, i do. i think whoever has the capacity of raping someone is a sick and monstrous individual who doesn't even deserve acquaintanceship with other human beings.

When drug addicts relapse, they only hurt themselves directly.
I don't want to risk a "rehabilitated" Rapist relapsing. I won't take that risk. Not when innocent women/infants are at risk

Not all abused become monster, but none ever completely heal.

Why allow those who sow this animosity and hatred inside someones heart to roam the streets?

I support capital punishment in numerous situations including this one. Prisoners are a waste of my tax dollars and a general plague on society. If you have committed a felony, and it is proven, against your fellow man you have broken your social contract with society and deserve to be killed. I don't believe in any of this "we're all human beings" liberal bullshit and I don't care if you think the prisoners COULD be rehabilitated.

Please tell me how many rapists you've come across, even years down the track that are truly remorseful for the rape or rapes they've committed? And 'healing' them? 'Intensive therapy' ? Please, tell me more about how you 'heal' someone who is obviously psychologically ill enough to carry out a rape in the first place.

I'm sorry you've not learned enough wisdom to be able to follow the lesson I am trying to teach.

The problem lies in the use of the word rapist, and that covers a variety of sins. There is on one end of the spectrum, and one of my favorite examples of a registered sex offender, person I know that was convicted of rape for having sex with a minor, they were married and now have two delightful children. My daughter sometimes plays with the older one. Now, I'm not real comfortable with a 14 year old having relationships with an 18 year old, I'd even agree that it is a crime. However, they've been married for 14 years now, however he's legally a rapist. Come to think of it, I believe my first wife was a rapist, in some jurisdiction. Reservation law holds, so it was legal.

Moving on, we have the stupid insensitive, get a woman drunk and have sex they shouldn't have. Still a crime, still a sin, but also something that surely can be rehabilitated.

Then we have the predatory, the violent stranger, the hold a knife to a stranger, doubt they can be rehabilitated.

Then, we have the child abuser, the worst of the worst.

So, I ask you, what kind of rapist are we talking about?

I'm not talking about statutory rape. That's a whole other issue.
There is no classification. As soon as you classify, you create excuses. Are you telling me that if a woman has passed out after having too much to drink, that the rape is not as valid as if a man held her a knifepoint in an alleyway? Rape is rape.

Yet, you classify by saying statutory is a whole other issue? Is a woman that takes advantage of a boy somehow different than a drunk man taking advantage of a drunker woman?

Elle, I have carried many a foolish girl back to her dorm/barracks, I've had many a boy arrested by MP's for being drunk. If you tell me that their bad behavior is as unredeemable as a premeditated predator I have to disagree.

I'd love for y'all all to adopt my culture point of view, that sex with a stranger is a blasphemy, but I don't expect you to.

P.S. Love the tag art/jaguar. Great image.

I'm talking about statutory rape being a completely different issue in the sense that its not always non-consensual, and that the issue there lies with ages an the idea of individuals being taken advantage of.

Are you again trying to justify the actions of a rapist by using the excuse that they were drunk? Are you telling me that they aren't as bad a person because they only raped when they were drunk? Are you telling me that whether the rape is premeditated or not determines how bad the rape was and how the 'rapist' should be punished? Again, RAPE IS RAPE.

Don't bring your culture into this, its irrelevant.

What kind of legal structure are you basing this on? I've never seen anything classified as "forcible rape" in PACE guidelines, the Sexual offences Act or Home Office Charging guidelines. There are such things as aggravating factors but I think you've been reading too much cosmo.

Statutory. If it's statuary rape, you're molesting a weeping angel. Also I'm fairly certain it's not restricted solely to "under 13" in the US at least, because 13 is not the age of consent in any US state that I've ever heard.

Wow, smart enough to correct my phone's auto-correct but not smart enough to know about the subject. Statutory rape has nothing to do with the age of consent and if you could read correctly without jumping too conclusions you'll know I used the UK as an example.

I support capital punishment in numerous situations including this one. Prisoners are a waste of my tax dollars and a general plague on society. If you have committed a felony, and it is proven, against your fellow man you have broken your social contract with society and deserve to be killed. Until someone frames your father, uncle, grandfather, cousin, friend, boyfriend, work acquaintance and are literally cheering for his death and watching them die a horrible, slow death. Then it turns out they were innocent, or were framed, and you get a half-arsed apology and a $10 gift certificate to use at Dennys.

Are you again trying to justify the actions of a rapist by using the excuse that they were drunk? Are you telling me that they aren't as bad a person because they only raped when they were drunk? I don't think you understand the complexities and seriousness of this subject. Rape is not always rape and sometimes culture is relevant. Hell, your own opinion is based on the culture that dictates how you should feel.

Why is bringing my culture into things always irrelevant, historically rape was an unknown crime among the Longhouse men, considering our lives are in the hands of the women I suspect that has something to do with it. Also, we actually were taught to respect women, that they are a little closer to God than we are, that they actually have souls. The Women of the Longhouse had political power when your women were powerless chattel, and your men bowed at the feed of your unworthy Kings. Why is that irrelevant. I suppose everything I have to say is irrelevant because I was half raised in such a culture, that there can not be any way nor manner different than the current dominant culture

Also, in my culture a one night stand/pick-up is a crime. How can you respect and know a person enough to have trust after just meeting them?
