TACOMA, Wash. -- A strange quirk in the law is allowing an accused child rapist to watch child pornography inside the Pierce County Jail.

Marc Gilbert is accused of sexually assaulting young boys and videotaping the abuse.

Under the law, defense attorneys are allowed to review material tied to the case. And because Gilbert has chosen to act as his own attorney, he has had unlimited access to the pornographic footage.

Therefore, the jail says it has no choice but to allow Gilbert to review the footage times over with no limits. Restricting his access would risk a mistrial.

Investigators seized from Gilbert's possession more than 100 DVDs containing 28 hours of pornographic footage. Some of the material was allegedly shot by the former jet pilot, and feature the young boys he's accused of luring to his home and exploiting.

The prosecutor and the sheriff say the results of the legal loophole are sickening in this case, but say the state Supreme Court has ruled in Gilbert's favor.

"Make no mistake -- I don't like it," said Pierce County Sheriff Paul Pastor. "But it is not my choice whether to do it or not to do it. There's no question that I don't like it. There's no question that this makes me grind my teeth."

"We don't like it. We don't want to do it, but we have to follow the law. The fix here is to change the law," said Pierce County Prosecutor Mark Lindquist.

To make sure no other inmates get a chance to see the pornography, Gilbert is made to review them in a separate room.

Child advocates say allowing the tapes to be viewed further victimizes the victims.

I wonder if he chose to act as his own attorney for those purposes...

should make him watch it with other inmates around. I'm sure at least one has a child and would be so disgusted that they would take actions into their own hands.

Inmates hate criminals who target children.

That is just sick... but it is necessary for the law to allow him to review the footages for fairness and all.

Oh god... what a loophole... i wonder if they are going to do something about this after the trial... change the law or something to avoid this circumstance? I don't know how they would though. :/ This is sad.

I think something should be said about it. I'm sorry, but our justice system is fucked up. I don't care if he chose to act as his own lawyer. They have video evidence that he filmed CP and therefore he is guilty of it. There doesn't need to be a trail. Makes me sick to my fucking stomach.

This could be used to their advantage, if the law let them. The prosecution I mean. Just film him (and him alone) and watch his reactions. That should get them something valuable. :|

Depends on what state you're in. The average recording laws require notification of the recorded party that they're being recorded. Only a few states don't.

Ugh, yes he is allowed, but that's just so wrong... he'll probably be free for who knows how long until the trial. He'll have so much CP to look through

Exactly the point. If they were able to monitor his unpleasant actions, then they'd have solid proof of his intentions and such.

Im pretty sure that's what Cory was hinting at. One glimpse of those tapes by other inmates would have him attacked nice n quick.

He is... he is in jail... being allowed to watch these videos.. cause he is his own lawyer..

Stupid. I had read the article, but I didn't realize the pornography was of him.

I mean, seriously, I am appalled. You have video evidence, and you're allowing him to watch it?
